11 September 2024: 13th Workers' Voice Breakfast

Olympus case before the CJEU and consequences for Workers' participation

 

The Hans Böckler Foundation invites participants to the Workers’ Voice Breakfast on Wednesday, 11 September 2024, from 08:30 to 10:00, at the Representation of the State of North Rhine-Westphalia to the European Union in Brussels. The event will focus on the CJEU’s “Olympus” case and its implications for workers’ participation.

The discussion will highlight the importance of workers’ codetermination for sustainable corporate governance in Germany and across Europe. Companies with codetermination tend to be more successful, resilient in times of crisis, and committed to long-term sustainability. Strengthening workers’ participation at both national and European levels is therefore crucial, especially in times of economic and social transformation.

However, the recent CJEU ruling in the “Olympus” case poses a serious threat to these participation rights. The judgment allows the creation of European Companies (SEs) without employee involvement on supervisory boards or in European Works Councils. This could undermine workers’ voice in company decision-making and weaken the European social and economic model.

During the breakfast discussion, Dr. Sebastian Sick, LLM, an expert in company law and codetermination, former member of SAP’s supervisory board, and current member of the German Corporate Governance Code Commission, will explore possible legal reforms needed to protect workers’ participation and promote sustainable corporate governance.

The event will provide an opportunity for exchange and informal discussion over coffee and croissants.
